General Provisions
O+ GmbH, Handelszentrum 16 / BT2 / EG, 5101 Bergheim, Austria (hereinafter referred to as "O+ GmbH" or "the organizer"), organizes prize draws or prize games for promotional purposes on the DOWN skis social media accounts and on the website www.downskis.com with known prizes (hereinafter referred to as the "prize game").
Purpose of the Prize Games
The purpose of the prize games is to promote the DOWN skis brand, activate DOWN skis brand enthusiasts, and increase traffic to www.downskis.com and the DOWN skis social media accounts.
Duration of the Prize Games
The prize games will take place from 5. 8. 2024 until revoked. Details about each individual prize game, such as the duration of each individual prize game and the method of participation, conditions of participation, possible prizes, etc., will be published in a post on the DOWN skis social media accounts at least during the duration of each individual prize game.
Participation in the Prize Games
- All adult individuals older than 18 years of age can participate in the prize game.
- Persons who are directly involved in the execution of the prize game cannot participate in the prize game.
- A condition for receiving prizes is that participants agree with the rules of the prize game.
- The rules of the prize game are available for inspection in written form at the organizer's address, O+ GmbH, Handelszentrum 16 / BT2 / EG, 5101 Bergheim, Austria.
- The list of winners is kept by the company O+ GmbH, Handelszentrum 16 / BT2 / EG, 5101 Bergheim, Austria.
- Winners of the prize game allow the publication of their personal name and surname or their Facebook name with a link to their profile on the DOWN skis social media accounts and on the website www.downskis.com.
- O+ GmbH, as the controller, manages, maintains, and supervises the collection of personal data of individuals in accordance with the Personal Data Protection Act and GDPR.
Prizes
- Prizes will be specified with each announcement of an individual prize game.
- Cash payouts of prizes, transfers, or exchanges of prizes are not possible.
Organizer's Responsibilities
O+ GmbH assumes no responsibility for:
- (Non)functioning of the social media where prize games will take place.
- The (in)accuracy of data sent by participants.ash payouts of prizes, transfers, or exchanges of prizes are not possible.
- Malfunctioning of the web service due to network outages of contract partners, power outages, or other technical disturbances that could temporarily hinder the use of the service.
- Any consequences that participants may suffer due to participation in the prize game.
- The organizer does not bear any costs incurred by participants due to participation in the prize games (using internet access, etc.). Participants participate in the prize game at their own risk.
- The organizer assumes no responsibility for any unwanted consequences that participants and/or any third party may suffer as a result of participation in the prize game.
- In the event of circumstances beyond the organizer's control (force majeure), the organizer may cancel the prize game. The participants must be informed about this through the media. In such a case, the organizer is not responsible for any potential damage incurred by the participants.
- In case of any dispute or ambiguity, these rules shall prevail.
- Participants can request the removal of their personal data obtained upon entering the game and overall participation in the prize game at any time by sending their request in the form of an email to info@downskis.com. This will also exclude them from the prize draw.
Non-Participation of Meta and its Platforms
Even when the organizer's prize game takes place on social media, Meta and its platforms do not sponsor the event and are not involved in any way. Therefore, the mentioned company and its platforms have no obligations or responsibilities towards the participants.
Final Provisions
The organizer reserves the right to change the rules if required by technical or commercial reasons or reasons on the part of the public. Changes will be published on www.downskis.com and on the DOWN skis social media accounts.
